TERMS OF SERVICE

1. General Information

These Terms of Service ("Terms") govern the use of the online store operated by:

hereinafter referred to as "IVE LABS", "we", "us" or "Seller".

Our online store is powered by Shopify, which provides the e-commerce platform enabling us to offer our products and services.

These Terms apply to purchases made through our online store and to the use of the website.

Nothing in these Terms limits or excludes any rights granted to consumers by mandatory provisions of Polish or European Union law.

2. Customers

Our store is available to both:

consumers purchasing products for purposes not directly related to their business or professional activity; and
business customers purchasing products in connection with their business or professional activity.

Certain provisions of these Terms apply specifically to consumers or specifically to business customers. Where required by applicable law, consumer protection provisions shall prevail over conflicting provisions of these Terms.

Customers are responsible for providing complete and accurate information necessary to process their orders.

3. Products

We make reasonable efforts to ensure that product descriptions, specifications, photographs, prices and other information presented in the store are accurate.

Minor differences in colour or appearance may occur due to display settings, manufacturing processes, materials used or the nature of the product.

Technical specifications and product descriptions available at the time an order is placed form part of the information concerning the product.

We reserve the right to modify our product range and discontinue products at any time. Such changes do not affect orders already accepted by us.

4. Custom-made Products

IVE LABS offers both standard products and products manufactured, configured or modified according to individual customer specifications.

Custom-made products may include products manufactured according to individually agreed dimensions, technical parameters, configuration, materials or other specifications selected or provided by the customer.

Where applicable under consumer law, the statutory right of withdrawal may not apply to goods made to the consumer's specifications or clearly personalised.

Where this exception applies, the customer will be informed before placing the order.

The mere fact that a product is manufactured after an order has been placed does not automatically make it a custom-made product excluded from the statutory right of withdrawal.

5. Orders and Formation of Contract

Products displayed in our online store constitute an invitation to place an order.

By submitting an order, the customer makes an offer to purchase the selected products under the conditions presented during checkout.

After placing an order, the customer will receive an electronic confirmation that the order has been received.

A sales contract is concluded when the order is accepted by IVE LABS, subject to mandatory provisions of applicable consumer law.

We may refuse or cancel an order where there is a legitimate reason to do so, including:

incorrect or obviously erroneous pricing;
product unavailability;
inability to process payment;
suspected fraud or unlawful activity;
inability to fulfil an individually specified product;
incorrect or incomplete customer information preventing fulfilment.

If payment has already been received for an order that we cannot accept or fulfil, the relevant amount will be refunded.

6. Prices and VAT

Prices displayed in the store are shown in the currency indicated on the website.

For customers for whom VAT is applicable, prices displayed as tax-inclusive include applicable VAT unless clearly stated otherwise.

The final price, including applicable taxes and any shipping charges, will be displayed before the customer submits the order.

For certain B2B transactions, intra-EU supplies, exports or other transactions subject to special VAT rules, the tax treatment may differ in accordance with applicable tax law.

Customers are responsible for providing accurate VAT identification and other business information where required.

7. Payment

Available payment methods are displayed during checkout.

Payment processing may be provided by Shopify and/or external payment service providers.

An order may be processed only after successful payment or payment authorisation where required by the selected payment method.

We do not necessarily receive or store complete payment card details.

8. Shipping and Delivery

Available shipping methods, estimated delivery times and shipping costs are displayed during checkout or otherwise communicated before the order is completed.

Delivery times are estimates unless expressly agreed otherwise.

We will make reasonable efforts to dispatch and deliver orders within the indicated timeframe.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier disruption, customs procedures, natural disasters, strikes or other force majeure events.

For consumers, the risk of accidental loss of or damage to goods passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods, except where otherwise permitted by applicable law.

Separate delivery terms may be agreed with business customers.

9. Right of Withdrawal and Returns

Consumers in the European Union generally have the right to withdraw from a distance contract within 14 days without giving a reason, subject to statutory exceptions.

Detailed information concerning withdrawal, returns, return shipping costs and refunds is provided in our Return and Refund Policy, which forms part of these Terms.

Unless otherwise provided by law or agreed by IVE LABS, the customer bears the direct cost of returning goods when exercising the statutory right of withdrawal.

The statutory right of withdrawal may not apply to goods manufactured according to the consumer's specifications or clearly personalised, where the requirements of applicable law are met.

Nothing in this section limits any mandatory consumer rights.

10. Defective or Non-conforming Products

IVE LABS is responsible for the conformity of goods with the contract to the extent required by applicable law.

If a product is defective, damaged or otherwise non-conforming with the contract, please contact:

and provide the order number and information reasonably necessary to identify and assess the problem.

Depending on the circumstances and applicable law, available remedies may include repair, replacement, price reduction or termination of the contract and refund.

Nothing in these Terms limits statutory consumer rights concerning non-conforming goods.

11. Business Customers

Where a customer purchases goods exclusively in connection with its business or professional activity, additional or individually agreed commercial terms may apply.

In particular, quotations, purchase orders, technical specifications, order confirmations or separately negotiated contracts may establish different provisions regarding delivery, acceptance, warranty, liability, payment or returns.

Where individually agreed contractual terms conflict with these Terms, the individually agreed terms prevail to the extent of the conflict.

Mandatory provisions of applicable law remain unaffected.

12. Intellectual Property

Unless otherwise stated, the website and its content, including trademarks, trade names, product names, text, photographs, graphics, technical materials, designs and other content, are owned by or licensed to IVE LABS and are protected by applicable intellectual property laws.

The content may be used for personal and lawful purposes connected with browsing our website and purchasing our products.

Without our prior permission, users may not reproduce, distribute, commercially exploit or modify protected content except where permitted by applicable law.

Nothing in these Terms transfers intellectual property rights to the customer.

13. Acceptable Use

You may use our website only for lawful purposes.

You must not:

interfere with the operation or security of the website;
introduce viruses, malware or other harmful code;
attempt unauthorised access to systems or accounts;
use the Services for fraudulent or unlawful purposes;
infringe intellectual property or other rights of third parties;
provide intentionally false or misleading information;
use automated systems in a manner that materially disrupts or overloads the Services.

We may restrict access to the Services where reasonably necessary to protect the website, customers or our legitimate interests.

14. Third-party Services

Certain functions of the store may be provided by third parties, including Shopify, payment providers, delivery companies and other service providers.

Use of certain third-party services may be subject to their own terms and privacy policies.

IVE LABS remains the seller of products purchased directly from our store. Shopify provides the technological platform and is not the seller of IVE LABS products.

15. Privacy and Personal Data

Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR where applicable.

Our Privacy Policy explains what personal information we collect, why we process it, how it may be shared and what rights individuals have regarding their personal data.

16. Liability

IVE LABS is liable in accordance with applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms limits mandatory rights available to consumers under Polish or European Union consumer protection legislation.

For business customers, liability may be subject to limitations contained in separately agreed commercial terms, quotations or contracts to the extent permitted by applicable law.

17. Force Majeure

IVE LABS will not be responsible for failure or delay in performing obligations caused by circumstances beyond our reasonable control, including natural disasters, war, civil disturbances, governmental actions, strikes, significant transport disruption, power or telecommunications failures or other comparable events.

This provision does not limit mandatory consumer rights.

Complaints concerning products, orders or the operation of the store may be submitted to:

Please provide sufficient information to identify the order and describe the issue.

We will process consumer complaints within the time limits required by applicable law.

19. Changes to These Terms

We may amend these Terms where reasonably necessary, including because of changes to applicable law, our Services, payment methods, delivery methods or technological requirements.

Changes will not adversely modify the terms applicable to orders already concluded unless required by law or agreed with the customer.

The current version of the Terms will be available on our website.

20. Governing Law

These Terms and contracts concluded through our store are governed by Polish law, subject to mandatory provisions protecting consumers.

If you are a consumer residing in another European Union Member State, the choice of Polish law does not deprive you of protection provided by mandatory provisions of the law of your country of residence where such protection applies.

Nothing in these Terms restricts a consumer's right to bring proceedings before a court having jurisdiction under applicable law.

For business customers, disputes may be subject to the jurisdiction of the competent Polish courts unless otherwise agreed in writing.
